General conditions of sale
Model of online terms and conditions of sale:
These conditions of sale are concluded on the one hand by the company Sensation Voltige with a capital of 10,000 euros whose registered office is Rue Henry Bessemer, 85000 la Roche-sur-Yon, registered in the commercial register under number 792 255 689 hereinafter referred to as "Sensation voltige" and on the other hand, by any natural or legal person wishing to make a purchase via the website of "Sensation Voltige" hereinafter referred to as "the buyer".
The flight is valid for one year from the date of purchase.
In accordance with the regulations in force on online purchases, the buyer has a withdrawal period of 14 days from the date of purchase for the services and from the date of receipt of the order for derivative products.
Regarding the Epsilon, Vintage, Reconnaissance, Combat and Extreme missions:
Theft is possible from the age of 12 with parental consent. A medical certificate of less than one month issued by a general practitioner, attesting to the absence of contraindications to the practice of air sports will be requested for people aged 70 and over, or for anyone with heart problems.
The passenger's height is limited to 1.90m, the weight is limited to 105kg.
Regarding the Jet Experience mission:
Theft is possible from the age of 15 with parental consent. A medical certificate of less than one month issued by a general practitioner, attesting to the absence of contraindications to the practice of air sports will be requested from all passengers.
The passenger's height is limited to 1.95 m, the weight is limited to 107 kg equipped.
The feasibility of the flight is confirmed the night before by SMS around 8 p.m. In the event of unfavorable weather, or for any other reason that prevents the maintenance of a sufficient level of safety, the flight may be postponed, at the sole decision of the Pilot.
Any cancellation by the customer less than 14 days before the appointment or no-show will result in the loss of the flight, except in cases of force majeure with proof.
Object
These conditions of sale are intended to define the contractual relations between Sensation Voltige and the buyer and the conditions applicable to any purchase made through the Sensation Voltige merchant site, whether the buyer is a professional or a consumer.
The acquisition of a good or service through this site implies an unreserved acceptance by the buyer of these conditions of sale.
These conditions of sale will prevail over all other general or special conditions not expressly approved by Sensation Voltige.
Sensation Voltige reserves the right to change its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
Characteristics of the goods and services offered
The products and services offered are those that appear in the catalog published on the Sensation Voltige website.
These products and services are offered within the limits of available stocks.
Each product is accompanied by a description established by the supplier. The photographs of the catalog are as faithful as possible but cannot ensure a perfect similarity with the product offered, especially with regard to colors.
The content of sensational flights is subject to modification depending on the weather or any other operating constraint.
Rates
The prices in the catalog are prices including VAT in euros taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.
Sensation Voltige reserves the right to change its prices at any time, it being understood, however, that the price on the catalog on the day of the order will be the only one applicable to the buyer.
The prices indicated include the costs of processing orders, transport and delivery as long as they take place in metropolitan France.
Refunds: no refund request will be admissible if the flight must be shortened at your request or for physical issues.
Orders
The buyer, who wishes to buy a product or service must:
– fill out the identification form on which he will indicate all the contact details requested or give his customer number if he has one;
– fill out the online order form by giving all the references of the products or services chosen;
– validate your order after checking it;
– make the payment under the conditions provided;
– confirm your order and payment.
The confirmation of the order implies acceptance of these conditions of sale, the recognition of having full knowledge of them and the renunciation of one's own conditions of purchase or other conditions.
All the data provided and the registered confirmation will be proof of the transaction. The confirmation will be equivalent to signature and acceptance of the operations carried out.
The seller will communicate by email confirmation of the registered order.
Retraction
Buyers, non-professional natural persons, benefit from a withdrawal period of fourteen days from their order to return the product to the seller for exchange or refund without penalty, with the exception of return costs.
Terms of payment
The price is payable at the time of order.
Payments will be made by credit card (only smart credit cards will be accepted); they will be made through the WIRECARD secure system which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and that no third party can read it during transport on the network.
At the request of the buyer, he will be sent a paper invoice showing the VAT.
Refunds
No refund request will be admissible in the event of a flight interruption depending on weather conditions or at the passenger's request, or for questions of physical condition.
Deliveries
Deliveries are made to the address indicated in the order form, which can only be in the agreed geographical area.
The risks are the responsibility of the buyer from the moment the products have left the premises of Sensation Voltige. In case of damage during transport, the reasoned protest must be made to the carrier within three days of delivery.
Delivery times are given for information only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.
Guarantee
All products supplied by the seller benefit from the legal guarantee provided for in Articles 1641 and following of the Civil Code.
In the event of non-compliance of a product sold, it may be returned to the seller who will take it back, exchange it or refund it.
All complaints, requests for exchange or refund must be made by post to the following address: Sensation Voltige, rue Henry Bessemer, 85000 la Roche sur Yon within thirty days of delivery.
Liability
The seller, in the online sales process, is only bound by an obligation of means; his liability cannot be held for damage resulting from the use of the Internet such as loss of data, intrusion, virus, service interruption, or other unintentional problems.
Intellectual property
All elements of the Sensation Voltige site are and remain the intellectual and exclusive property of Sensation Voltige.
No one is authorized to reproduce, exploit, rebroadcast, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound.
Any simple or hypertext link is strictly prohibited without the express written consent of Sensation Voltige.
Personal data - Privacy
In accordance with the law on data processing, files and freedoms of January 6, 1978, personal information relating to buyers may be subject to automated processing.
Sensation Voltige reserves the right to collect information about buyers including the use of cookies.
Buyers can object to the disclosure of their contact information by reporting it to Sensation Voltige. Similarly, users have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978.
The automated processing of information, including the management of e-mail addresses of site users, has been the subject of a declaration to the CNIL.
Archiving - Evidence
Sensation Voltige will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.
V.'s computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
Dispute Resolution
These online conditions of sale are subject to French law.
In the event of a dispute, jurisdiction is attributed to the competent courts of La Roche sur Yon, notwithstanding the plurality of defendants or an appeal in guarantee.
